California Property Tax Protest Guide for 2026

California’s property tax framework is unique. Proposition 13 (1978) sets the assessed value at acquisition price and limits annual increases to 2% of the factored base year value. Proposition 8 (also 1978) lets you request a temporary reduction when current market value falls below the factored base year value. Together they create two distinct appeal paths: a Prop 8 decline-in-value claim, and a regular AAB challenge to the assessor’s determination.
California Filing Deadline
Most California counties operate on one of two schedules:
- September 15: counties that mail Notices of Assessed Value by August 1 (Los Angeles, Orange, San Diego, Santa Clara, San Mateo, Alameda, and many others).
- November 30: counties that don’t mail value notices to all owners.
Always confirm with your specific County Assessment Appeals Board (AAB). Missing the deadline forfeits the entire appeal year.
Two California Appeal Paths
- Prop 8 decline-in-value (informal). The fastest path. Most large counties accept Prop 8 review requests through the assessor’s website with no fee. The assessor reviews recent comps and may grant a temporary reduction without a formal hearing. Open windows usually run January through August. Read our full Prop 8 guide.
- Regular AAB appeal (formal). File an Application for Changed Assessment with the county AAB. The AAB is a separate body from the assessor and typically holds hearings within 12–24 months. Best for cases where the informal Prop 8 review didn’t resolve, or where you’re challenging the underlying base year value (e.g., disputing the original purchase-price determination after a transfer).
Statutory authority: California Revenue and Taxation Code §1603 (regular appeals) and §51 (Prop 8).
What Counts as Strong Evidence
The lien date in California is January 1. Your evidence must establish market value as of that date for the appeal year. The strongest evidence:
- 3–5 comparable sales within 1/2 mile, ideally in the same subdivision or neighborhood block.
- Sales within 90 days of January 1 of the appeal year. Older sales need market-trend adjustment.
- Similar size, age, condition, and lot. Adjustments should be defensible and modest.
- Photos of condition issues — deferred maintenance, foundation, dated finishes, drainage, location problems.
- For Prop 8: documented comparable sales below your factored base year value.

California Effective Tax Rates
California’s base statutory rate is 1% of assessed value (Prop 13). Voter-approved bonds, parcel taxes, and Mello-Roos community facilities district (CFD) assessments push effective rates higher — commonly 1.05% to 1.25%, occasionally over 1.5% in newer master-planned communities. A successful protest reduces the assessed value, which proportionally reduces all of these.
Common California Mistakes
- Filing in the wrong window. Informal Prop 8 review is open most of the year; formal AAB has strict deadlines.
- Using the wrong lien date. California lien date is January 1, not your purchase or notice date.
- Asking the AAB to remove parcel taxes / CFDs. Those are voter-approved special assessments, not assessed value — the AAB can’t touch them.
- Missing supplemental assessments. If you bought recently, your factored base year value resets to purchase price; appeal it within 60 days of the supplemental notice if you believe the price doesn’t reflect market value.
